Our Terms And Conditions Of Service

Terms and Conditions are the standard conditions by which Boothin’ it! (the “Supplier”) agrees with the Client (the “Client”) to supply the Service specified in this Agreement. These Terms and Conditions constitute the whole Agreement and the confirmation e-mail (the “Agreement”) between the Client and Supplier. This Agreement supersedes all prior Agreements. These Terms and Conditions can only be varied if expressed in writing by the Supplier.

Payment, Fees and Cancellation Charges

Once the non-refundable booking fee of £100 has been received, and the confirmation e-mail has been issued to the Client, this Agreement will be binding.

The balance of the agreed rental charge is due 14 days before the event. The deposit you pay is non-refundable 30 days leading up to your event, and reflects the work we put into events prior to attending, and the bookings we will have missed by reserving this date for you.

If the booth hire is required for a period in excess of the agreed service period, additional rental charges will be payable by the Client to the Provider, calculated on a pro-rata basis.

Payment of all additional rental charges must be made by the Customer before any additional service period commences.

If the Client cancels an agreed rental of the Photo Booth less than 30 days before the rental date the deposit paid will be forfeited.

If the Client cancels an agreed rental of the Photo Booth within thirty days before the rental date the full amount will be forfeit.

Any cancelled order is subject to the following cancellation charges:

Within 8 weeks prior to event 20% of order value

Within 6 weeks prior to event 50% of order value

Within 4 weeks prior to event 75% of order value

Within 2 weeks prior to event 100% of order value

Date Changes

Any request to alter the agreed date of the rental of the Photo Booth must be made in writing and at least 30 days prior to the Client’s event

Any change of date is subject to the availability of the Photo Booth on the alternative date and receipt of a new booking contract.

Within 4 weeks prior to event 75% of order value

Within 2 weeks prior to event 100% of order value

Space & Power Requirements

The Photobooth must have suitable cover (ie indoors or under weather proof shelter) and level ground when in marquee. The Client will arrange for an appropriate space to be made available for the Photo Booth at the event venue. A minimum floor area of 3m x 3m is required. Always consider prop/scrapbook tables and areas to queue on top of set area. If our area is too small we cannot be held responsible for loss of additional services

The Client will provide a mains electricity supply comprising a single 13amp socket located within the space designated by the Client for the Photo Booth

Venue Access & Location

It is the Client’s responsibility to ensure you have provided the venue contact information, address, name, and postcode for our attendants to find you. We also require that the venue allows reasonable access for loading, and suitable parking once the booth and equipment has been unloaded. The Client must pay for any parking or Congestion charges incurred. If parking for loading is restricted you will be liable for any fines that occur as a result and or time used seeking a suitable location. We cannot be held responsible for any errors or delays resulting from incorrect or missing address details.

Unavoidable Circumstances

We will not be liable and no compensation will be paid for any act of nature, vehicle breakdown or any other act out of our control that prevents us from turning up to your event.

We will not be liable and no compensation will be paid for any unexpected equipment breakdown, although all attempts will be made to repair/replace the item(s).

However, in the case that we cannot attend or fulfill your hire due to events beyond our control we will contact you or the venue as soon as possible, if a situation beyond our control occurs we try to find either a replacement booth or a replacement company to step in. In these instances our liability will be limited to the refunding all of monies paid should no service be offered.

Set-up of Services

We will arrive to set up approximately 45-90 minutes before the hire period is due to commence. If you require the booth to be set up earlier an idle time charge applies.

It is your responsibility to ensure that the venue has agreed for us to be in attendance at their venue and at the agreed time. This also includes ensuring that there is access to enter the venue and enough space with a power socket within 2 metres of where the services are to be. If there is insufficient space for us to set up you will still be charged the full hire amount.

It is your responsibility to inform us of any circumstances that may make setting up take longer, these may include but are not exhaustive to; going upstairs, a long distance from unloading area to set-up area, restricted access. If we are not aware of these and the set-up takes longer than normal your hire period may be intruded into.

Hire Period

The hire period will be for a set period, typically three hours, but as specified in the booking form and as agreed by both parties before. In addition this will cover the 45 – 90 minute setup time and 30-45 minute pack down time. Use will commence at the agreed time and finish at the agreed time in the booking form unless due to technical difficulties on our behalf, when we provide the service for the set period once rectified.

If your event simply starts late or runs late, our period of hire will still be for the agreed period and times unless we agree to provide additional hours as per our additions.

Service Period

The Provider agrees to provide a Photo Booth operational and available for use for a minimum of 85% of the agreed service period , to permit maintenance of the Photo Booth should any be necessary – Reloading paper & ink, general maintenance, re-aligning backdrops, changing batteries, to name but a few and other situations which may arise during an event are inevitable from time to time.

Loss or damage to providers equipment

The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests .

The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft , Fire, Flood or Accidental Damage.


The Customer agrees to, and understands the following:

1. a) The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of the Provider’s equipment .

2. b) The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken at the Customer’s event by the Photo Booth or by its operatives , employees or affiliates .

Termination of Hire

We will not tolerate any abuse or threatening behaviour to our employees. If this occurs we retain the right to terminate the hire, with no refund payable for hire time that has been cut short. We are providing a service to you , and therefore our staff should be treated with the respect they deserve.

We also retain the right to terminate a hire if they feel that any equipment or property belonging to us is in danger of being damaged or has been damaged due to unruly behaviour from you. We also reserve the right to refuse guests to participate in the activities if we feel they are too unruly.

In any instances where we feel there is a need to terminate the hire we will attempt to speak with you or the hosting venue first, if possible to try to resolve the matter before termination.

You will be fully responsible for any damages caused by you or any other attendees at the event to the booth or booth equipment howsoever caused, with the sole exclusion of our staff.

In the event of any damages caused by those present to property or equipment in use by us, you will be charged the full replacement cost and are liable to cost involved in termination of future events due to sourcing replacements.

Any damages must be reported to a member of our staff immediately.

The Customer agrees to, and understands following:

All persons using the Photo Booth at the Customer’s Event hereby give to Boothin’ it! the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.

In addition the Customer , hereby releases, discharges and agrees to maintain Boothin’ it! free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.

All digital images remain the property of the Supplier at all times – The 1988 Copyright Design & Patents Act – section 77 & 80 assigns copyright of all digital images to the Supplier. It is contrary to the act to copy or allow to be copied photographs captured by the Supplier by any means.

Unless otherwise agreed in writing prior to the Event, the Client grants the Supplier full rights to use any digital images taken at the Event (inside or outside of the photo booth) on the Supplier’s website, social media platforms and other marketing material without limitation.

Miscellaneous terms

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.

This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.

In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational Photo Booth for at least 80% of the agreed service period, the Provider shall make a refund to the Customer calculated pro rata from the total charge made for the agreed service period.

Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event , the Provider will reprint all photos off-site and send via Royal Mail Special Delivery Guaranteed Mail within 7 days of the event to an address specified by the Client – these will be supplied and delivered free of charge.

Boothin’ it! is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
